Welcome to Muong Lay Tour Application. To use the Application, please read carefully and accept the Terms and policies below.

1. SCOPE OF APPLICATION

- Muong Lay Town Smart Tourism Application is developed by IGB Joint Stock Company and operated by Muong Lay Town People's Committee. Participating members are the tourism management agency - Muong Lay Town People's Committee in charge of tourist areas in the area; businesses, organizations, individuals with legal commercial activities and tourists ("Users").

- Products and services participating in transactions must fully comply with relevant legal regulations and not be prohibited from trading or advertising as prescribed by law. The purchase and sale of goods and provision of services via the Muong Lay Tour application must be carried out publicly and transparently, ensuring the rights of consumers.

(1) The following terms (“Terms of Service”) describe the terms and conditions that apply to your access to and use of the Services provided by Muong Lay Town People's Committee and any related software and products. This document is a legally binding agreement between you and Muong Lay Town People's Committee. To access and use the Services, you must register for an account through the Muong Lay Tour application (“Account”). When we write “you” or “your”, we mean the owner, agent or employee of the Service registration Account.

(2) These Terms of Service apply to all Services owned and provided by Muong Lay Town People's Committee or our Affiliates. By registering for the Service, you agree to be bound by the Terms of Service. Any new features or tools which are added to the current Service shall also be subject to the Terms of Service. We reserve the right to update and change the Terms of Service by posting updates and changes. You should check the Terms of Service periodically to be aware of any updates or changes that may affect you.

(3) All contents in these Terms of Service must comply with the current legal system of Vietnam. When participating, members must understand their legal responsibilities under the current laws of Vietnam and commit to properly implementing the contents of these Terms of Service.

2. GENERAL PROVISIONS

2.1. General information

- Muong Lay Town, Dien Bien Province, located in the North of Vietnam, is an important intersection between the Northwestern mountainous provinces. With an area of ​​about 112.67 km² and a population of 11,618 people in 2022, the population density is 103 people/km². Muong Lay is the town with the lowest population and also the town with the fewest wards and communes in Vietnam today. Muong Lay Town has 3 administrative units at the commune level, including 2 wards: Na Lay, Song Da and Lay Nua commune.

- Muong Lay has a strategic location along National Highway 6 and the Da River, creating favorable conditions for economic development, trade and tourism.

2.2. General definition

- Sellers (Payment acceptance points): are small and medium-sized enterprises, family businesses, traders, and individuals who are approved by the People's Committee of Muong Lay Town to use the Services provided by the People's Committee of Muong Lay Town and related parties. Through the Muong Lay Tour application, Seller(s) create booths to display, introduce and perform other activities to provide Products to Buyers. In addition, the application also provides tools for Sellers to record order transactions, revenue and expenditure, and manage stores and underlying debt transactions during the process of organizing business and buying and selling.

2.3. Users: includes both Sellers and Buyers

- Members must register to initially declare relevant personal information, be officially recognized by the Board of Directors and be allowed to use the service. Members can create an account to use or operate. Members can receive information about products and programs.

2.4. Board

- The Management Board is a group that develops and operates tourism management and business applications, authorized by the People's Committee of Muong Lay Town to be responsible for and manage the Services and related issues.

2.5. Privacy

- Muong Lay Town People's Committee values ​​the security of your information. To protect the rights of Users, Muong Lay Town People's Committee provides a separate Privacy Policy to explain in detail the security activities of Muong Lay Town People's Committee. Please refer to the Privacy Policy to know how Muong Lay Town People's Committee collects and uses information related to the User's Account and/or use of the Service ("User Information"). These Terms of Service are closely related to the Privacy Policy. By using the Service or providing information on muonglaytour.vn, Users:

- Allow Muong Lay Town People's Committee to collect, use, publish and/or process your personal content, data and User Information for the purpose of improving product quality and customer care, as specified in the Privacy Policy;

- Agree and acknowledge that the information provided on the Muong Lay Tour application will be owned by you; and you have the right to request deletion of such data at any time.

- Will not, directly or indirectly, disclose User Information to any third party, or in any way allow any third party to access or use your User Information.

- In the event that a User possesses personal data of another User through the use of the Service (“Recipient”), it hereby agrees that it will (i) comply with all legal regulations on the protection of personal information security related to such information; (ii) allow the User who is the owner of the personal information collected by the Recipient (“Disclosing Party”) to delete his/her information collected from the database of the Recipient; and (iii) allow the Disclosing Party to review the information collected about him/her by the Recipient, in accordance with or as required by applicable legal regulations.

3. LIMITATION OF LIABILITY

- Muong Lay Town People's Committee grants Members the appropriate right to access and use the Services subject to the terms and conditions set forth in these Terms of Service. All proprietary Content, trademarks, service marks, trade names, logos and other intellectual property (“Intellectual Property”) displayed on the muonglaytour.vn Site are owned by Muong Lay Town People's Committee and third party owners, if any. No party accessing the muonglaytour.vn Site is granted any right or license directly or indirectly to use or copy any Intellectual Property, nor is any party accessing the Site permitted to claim any right, title or interest in or to the Intellectual Property. By using or accessing the Service, you agree to comply with the laws relating to copyright, trademark, service mark or any other legal provisions protecting the Service, Tourism Management and Business and the Content of the site.

- You agree not to copy, distribute, republish, transfer, publicly display, publicly perform, modify, adapt, rent, sell, or create derivative works of any part of the Service of the tourism management and business application and the Content of the application. You may not duplicate or edit any part or all of the content of the Muong Lay Tour application on any server or as part of any other website without receiving the written approval of the People's Committee of Muong Lay Town. In addition, you agree that you will not use any robot, spider or other automatic device or manual process to monitor or copy the Muong Lay Town People's Committee Content without the prior written consent of Muong Lay Town People's Committee (such consent is deemed to apply to basic search engines on web search websites that link users directly to that website).

- Any software provided by Muong Lay Town People's Committee to Users is subject to these Terms of Service. Muong Lay Town People's Committee reserves all rights in and to the software not expressly granted by Muong Lay Town People's Committee hereunder. Any scripts or code, linked to or referenced from the Service, are licensed to you by the third parties who own such scripts or code, not by Muong Lay Town People's Committee.

4. ACCOUNT AND SECURITY

(1) Certain features of our Services require you to register for an Account by entering your personal phone number as a login name (“Login Name”) and password and providing certain personal information. You may use your Account to access other products, websites or services that Muong Lay Town People’s Committee has enabled, has a relationship with or is collaborating with. Muong Lay Town People’s Committee has not reviewed and is not responsible for any content, features, security, services, privacy policies, or other practices of those products, websites or services. In the event that you use your Account to access other products, websites or services that Muong Lay Town People's Committee has authorized, has a relationship with or is collaborating with, the terms of service of those products, websites or services, including their respective privacy policies, will still apply when you use those products, websites or services even if these terms of service are different from the Terms of Service and/or Privacy Policy of Muong Lay Town People's Committee.

(2) You agree to (a) keep your password confidential and use only your Username and password when logging in, (b) ensure that you will log out of your account at the end of each session, and (c) immediately notify Muong Lay Town People's Committee of any unauthorized use of your Account, Username and/or password. You are responsible for all activity under your Username and Account, including any loss or damage arising from unauthorized use of your password or from your failure to comply with these Terms.

(3) You agree that Muong Lay Town People's Committee has the right to immediately terminate your Username and Account, remove or delete from the Muong Lay Tour Application any Content associated with your Username and Account for any reason, with or without notice or liability to the User or any third party. Grounds for such action may include (a) prolonged inactivity of the Account and Username, (b) violations of the letter or spirit of these Terms of Service, (h) conduct that is harmful to other Users, third parties or the economic interests of Muong Lay Town People's Committee. Use of the Account for illegal, fraudulent, harassing, infringing, threatening or abusive purposes may be reported to the competent state agency as prescribed by law.

(4) The User may request deletion of the Account by notifying in writing to the People's Committee of Muong Lay Town. However, the User shall still be responsible and liable for any uncompleted transactions (arising before or after the account is deleted) or the transportation of goods related to the account requested to be deleted. In that case, according to the Terms of Service, the User shall contact the People's Committee of Muong Lay Town after promptly and completely performing and completing the uncompleted transactions. The User shall be responsible for his/her request to delete the Account.

(5) You may only use the Service and/or open an Account at the People's Committee of Muong Lay Town if you meet the conditions to accept these Terms of Service.

5. TERMS OF USE

(1) The license to use the Muong Lay Tour application is effective until terminated. The license to use will be terminated in accordance with these Terms of Service or in the event that the User violates any term or condition set forth in these Terms of Service. In such event, the Muong Lay Town People's Committee may terminate the User's use with or without notice.

(2) Remove any proprietary notices from Muong Lay Town People's Committee

  • Use the Service for the benefit of any third party or any conduct that is not acceptable under these Terms of Service;
  • Use the Service or post Content for fraudulent, unreasonable, false, misleading or confusing purposes;
  • Open and operate multiple user accounts in connection with any conduct that violates the terms or spirit of these Terms of Service;
  • Access the muonglaytour.vn Site, open an account or otherwise access your user account through any software or hardware not approved or provided by muonglaytour.vn, including emulators, emulators, automated software or any software, devices or hardware with similar functionality.
  • Edit other Users' Content.
  • Take any action that circumvents the Muong Lay Town People's Committee's feedback or review system;
  • Attempt to decompile, reverse engineer, disassemble or hack the Services (or any portion thereof); or defeat or overcome any encryption technology or security measures implemented by Muong Lay Town People's Committee with respect to the Services and/or data transmitted, processed or stored by Muong Lay Town People's Committee;
  • Harvest or collect any information related to another User's Account, including any personal information or data; upload, email, post, transmit or otherwise make public any Content that you do not have a right to under any law or contractual or fiduciary relationships (such as inside information, proprietary information and confidential information learned or disclosed as part of employment relationships or under confidentiality agreements);
  • Upload, email, post, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party;
  • Upload, email, post, transmit or otherwise make available any unauthorized or unlawful advertising, promotional materials, “spimmage,” “spam,” “chain letters,” or any other form of unauthorized solicitation;
  • Upload, email, post, transmit or otherwise make available any material that contains any computer viruses, worms, files or programs designed to directly or indirectly interrupt, manipulate, disrupt, destroy or limit the functionality or integrity of any computer software or hardware or data or telecommunications equipment;
  • Disrupt the normal flow of interaction, increase the speed of “scrolling” the screen faster than other Users are able to on the Service, or otherwise take action that negatively affects the ability of other Users to engage in real-time transactions,
  • Interfere with, manipulate, or disrupt the Service or servers or systems connected to the Service or other Users’ use and enjoyment of the Service, or disobey any requirements, procedures, policies, or regulations for systems connected to the Muong Lay Town People’s Committee;
  • Take any action or conduct that could directly or indirectly damage, disable, overburden, or impair the Service or servers or systems connected to the Service;
  • Use the Service to intentionally or unintentionally violate any applicable local, federal, national or international laws, regulations, rules, directives, guidelines or policies (whether or not in force) relating to anti-money laundering or counter-terrorism;
  • Use the Service to violate or circumvent any sanctions or embargoes administered or enforced by relevant authorities.
  • Use the Service to invade the privacy of others or to “stalk” or otherwise harass others;
  • Infringe the rights of the People’s Committee of Muong Lay Town, including any intellectual property rights and create confusion over such rights;
  • Use the Service to collect or store personal data of other Users in connection with prohibited conduct and activities.

(3) The User understands that the Content, whether publicly posted or privately transmitted, is the sole responsibility of the person from whom such Content originated. This means that you, not the People's Committee of Muong Lay Town, are solely responsible for the Content that you upload, post, email, transmit or otherwise make available on the muonglaytour.vn Site. The User understands that by using the muonglaytour.vn Site, you may encounter Content that you consider offensive, indecent or inappropriate. The People's Committee of Muong Lay Town will not be liable for the Content, including any errors or omissions in the Content, or any loss or damage arising from the use of, or reliance on, the Content posted, emailed, transmitted or otherwise made available on the muonglaytour.vn Site.

(4) The User acknowledges that Muong Lay Town People's Committee and its designees have the right (but not the obligation) to screen, refuse, delete, stop, suspend, remove or move any Content available on the muonglaytour.vn Site including any Content or information you have posted. Muong Lay Town People's Committee has the right to remove Content (i) that violates the Terms of Service; (ii) in the event that Muong Lay Town People's Committee receives a valid complaint under the law from another User; (iii) in the event that Muong Lay Town People's Committee receives a valid notice of intellectual property infringement or a legal request for removal; or (iv) other causes under the law. Muong Lay Town People's Committee reserves the right to block communications (including status updates, postings, messages and/or chats) on or related to the Service as part of our efforts to protect the Service or Muong Lay Town People's Committee Users, or otherwise enforce the terms of these Terms of Service. Users agree that they must evaluate, and bear all risks associated with, their use of any Content, including any reliance on the accuracy, completeness, or usefulness of such Content. In this regard, Users acknowledge that they have not and, to the fullest extent permitted by law, should not rely on any Content created by Muong Lay Town People's Committee or submitted to Muong Lay Town People's Committee, including information on Facebook pages.

(5) The User accepts and agrees that the Muong Lay Town People's Committee may access, maintain and disclose the User's Account information in cases where required by law or by order of a court or government agency or competent state agency requesting the Muong Lay Town People's Committee or other reasons as prescribed by law: (a) to comply with legal procedures; (b) to enforce the Terms of Service; (c) to respond to complaints that the Content infringes upon the rights of third parties; (d) to respond to User requests related to customer care; or (e) to protect the rights, property or safety of the Muong Lay Town People's Committee, Users and/or the community.

6. TERMS OF SERVICE

Violation of this policy may result in a number of actions, including any or all of the following:

  • Delete product category.
  • Delete debit or revenue and expenditure transactions.
  • Limit the right to use the Account.
  • Suspension and Termination of Accounts.
  • Criminal charges.
  • Apply civil remedies, including claims for damages and/or injunctive relief.
  • Other actions or sanctions under the Operating Regulations or Policies of the Tourism Business and Administration application.

- Easily build convenient travel routes, saving time.

- During and after using the services of tourism service providers, customers can request support & assistance with real images/videos to verify information to reflect on the quality of service. Customer feedback will be received, processed or forwarded to relevant agencies for timely handling if there are acts of commercial fraud, false advertising, price gouging, etc. by the People's Committee of Muong Lay Town.
